David Francisco focuses his practice on criminal defense, appeals and other post-conviction matters, and family law. A veteran trial attorney with 68 jury trials to verdict, David brings a wealth of procedural knowledge and courtroom experience to his clients.
Prior to establishing Francisco Britton LLP, David was a Deputy Prosecuting Attorney in Elkhart County for over 10 years where he established a reputation for handling complex criminal matters. He successfully prosecuted 13 murder cases, including one capital murder conviction resulting in a sentence of life without parole. In addition to murder cases, he was also responsible for prosecuting other major felonies such as attempted murder, armed robbery, drug dealing and manufacturing, child victim crimes, burglaries, conspiracies, and racketeering cases. David has litigated over 100 post-conviction relief proceedings.
David is active in the community. He presently serves on the Board of Directors for the Northern Indiana Chapter of the American Red Cross, and is a member of the Elkhart Noon Kiwanis Club and the Elkhart League of Women Voters. David previously volunteered as a coach for the mock trial teams of the University of Notre Dame Law School and South Bend John Adams High School. David is a member of the American Bar Association and the Indiana State Bar Association.

Peter Britton practices in all areas of criminal and family law, with a strong interest toward both civil and criminal trial practice. During his tenure as a deputy prosecutor, Peter tried approximately 70 jury trials to verdict and secured approximately a million dollars in asset forfeiture litigation on behalf of Elkhart County.
Peter was a founding partner of Francisco Britton LLP in 2016. Prior to establishing the firm, Peter was a Deputy Prosecuting Attorney in Elkhart County, Indiana, since 2005. Peter’s primary responsibilities as a deputy prosecutor were drug crimes, working closely with area law enforcement, investigating and prosecuting drug dealing, possession and manufacturing cases. Peter also assisted the Elkhart County Interdiction and Covert Enforcement Unit (ICE Unit) in the execution of their long-term investigations, which included handling Elkhart County’s civil forfeiture program. Peter's responsibilities included investigating corrupt business influence (Indiana’s RICO violations) allegations and navigating those complex cases through the judicial system. Towards the end of his career as a prosecutor, Peter was assigned to child victim crimes handling child battery, child molestation and sexual misconduct with a minor prosecutions.
Prior to his career as a prosecutor, Peter worked as a law clerk for the major felony division of the Lake County, Indiana, public defender’s office. Peter lives in the Michiana area with his wife and two young children. Peter's family has a deep history in Northern Indiana, spanning 4 generations.
